These terms govern your use of goodnessfactor.com and the Goodness Factor program (the “Service”), run by The Goodness Factor (“we,” “us”). By using the Service you agree to them. If you use the Service on behalf of a school, you confirm that you are authorized to bind the school, and “you” includes the school.

1. Who may use the Service

The logged-in program is for school staff aged 18 or over: admins, teachers and counselors. Children do not have accounts. A school is responsible for the staff it invites and for removing access when someone leaves.

2. Accounts

You sign in with your email address and a verification code. Keep your email account secure; entries made from your account are attributed to you. Tell us at once if you believe your account has been used by someone else.

3. The school's responsibilities

• Obtain any consent that your policies and the law require before entering information about a child, and give families the notice they are entitled to.
• Enter only what the program is for: a child's name, class, and the acts, confirmations, deductions and restorations your staff witnessed or handled. Keep notes factual and brief. Do not enter health, religious, political or other sensitive information.
• Use the program in the spirit of its design: equal criteria for every child, recognition over ranking, counseling first, and a way back after every deduction.

4. The record

Entries are written once and attributed to the staff member who made them. A mistake is corrected by a new entry that says so; the history is not rewritten. A staff member who enters acts that did not happen, or alters the record in any other way, loses the right to enter, as the method requires, and the school will be told. A school may ask us to delete or de-identify a child's record as described in the privacy policy.

5. Acceptable use

Do not use the Service to harm, harass or embarrass any child or adult; to collect information about children for any purpose other than the program; to probe, scan or disrupt the Service; or to gain access to another school's data. We may suspend an account or a school that does.

6. Fees

A pilot is free for the pilot school for the agreed semester. Any continuing use is on the terms of a written agreement with the school. We will not charge a school without its written agreement.

7. Intellectual property

The Goodness Factor method and book are by Mohanji. The acts of goodness and the program materials are provided for schools to use within the program. The Service's software, design and content are ours or our licensors' and are protected by law; you may not copy, modify or redistribute them except as expressly allowed. We intend to publish the platform's code under an open-source license and will say so here when we do. The school's data remains the school's.

8. Availability and changes

We work to keep the Service available and may change or improve it over time. We will tell schools in advance of changes that affect how they use it. We may suspend the Service for maintenance or security.

9. Disclaimer and limitation of liability

The Service is provided “as is.” We do not promise that it will be uninterrupted or error-free, or that it will produce any particular educational outcome. To the extent the law allows, we are not liable for indirect, incidental or consequential loss, and our total liability for any claim is limited to the amount the school paid us for the Service in the twelve months before the claim, or one hundred US dollars if nothing was paid. Nothing in these terms limits liability that cannot be limited by law.

10. Ending use

A school may stop using the Service at any time and export its records. We may end a school's access for a material breach of these terms that is not cured within thirty days of notice, or at once for a breach of section 5. After access ends, records are kept and deleted as the privacy policy describes.

11. Governing law

The Service is offered to schools in any country. Unless the school's written agreement with us names another law, these terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules, and disputes are resolved in the courts located there. A school's agreement may name the law and courts of its own country.

12. Changes to these terms

When we change these terms, we update the date at the top and, for changes that matter, tell schools by email before they take effect. Continued use after that is acceptance of the new terms.
